The Answer of ye Vice Chancellor & Senate of ye Vniversity of Cambridge to ye Question, why they did not Admitt Alban ffrancis to ye Degree of Master of Arts in ye same Vniversity according to his Mats. Mandatory Letters under his Signe Manual.

The said Vice Chancellor & Senate for & in behalfe of themselves & ye sd Vniversity, say yt by ye Statute made 1mo Eliz: Entituled an Act to restore to ye Crowne ye ancient Iurisdiccons over ye State Ecclesiasticall & Spirituall, & abolishing fforeigne power reꝑgnt to ye same, It is Enacted amongst other things yt every person yt shall be promoted to any degree of Learning in any Vniversity within this Kingdome, before he shall receive or take any such Degree shall before the Chancellr or ViceChancellor of ye Vniversity take ye Oath in yt Statute menconed & appointed, purporting yt he doth thereby testifie and declare in his Conscience yt his Matie is ye onely supreame Governor of this Realme, as well in all Spirituall & Ecclesiasticall things and causes, as Temporall. That no fforreigne Prince, Person, Prelate, State or Potentate hath or ought to have any Iurisdiccons, Superiority or authority Ecclesiasticall or Spirituall within this Realme, and yt therefore he doth renounce & forsake all forreigne Iurisdiccons & authorities & promise to beare ffaith & true Allegiance to the King his Heires & Successors & to his power assist & Defend all Iurisdiccons & authorities Granted, Vnited, annexed or belonging to his Mats Imperiall Crowne of England.

That by ye Statute made 5. Eliz: Entituled an Act for ye Assurance of ye Queen's Royall Prerogative over all Estates & Subjects within her Dominions.

It is likewise enacted yt every ꝑson yt shall be admitted to any degree of Learning in any ye Vniversityes before he shall be allowed or suffered to take upon him such Degree shall take the foremenconed Oath before such ꝑson or ꝑsons as shall have authority by com̄on Vse, or otherwise to admitt to such Degree.

That by ye Statute made by his Mats. Royall Grandfather King Iames ye first in ye third yeare of his Reigne Entituled an Act for ye better discovering & repressing of Popish Recusants. Another Oath is prscribed com̄only called ye Oath of Obedience by wch Oath ye ꝑson yt <1v> takes it amongst other things is enjoyned to sweare yt his Matie is the Lawfull & rightfull King of this Realme, & of all other his Dominions & Countries. And yt neither ye Pope of himselfe, nor by any other means hath power or authority to depose his Matie or dispose of any his Kingdomes or Dominions, or to Authorize any fforreigne Prince to invade them, or discharge his Subjects from their Obedience or Allegiance to his Matie, or to give leave to bear Armes agt him, & yt he will bear faith & true Allegie|a|nce to his Matie & him will Defend to ye Vtmost of his power. And afterwards by ye Statute made in ye seventh year of ye Reigne of his Mats sd Royall Grandfather Entituled an Act for ye Administring ye Oath of Allegiance.

It is enacted yt ye sd last menconed Oath shall by ye ViceChancellr. & Principalls of houses in ye Vniversity be publiquely taken in ye Convocacon before ye Senior Masters & by every other ꝑson yt should be promoted to any Degree in Schoole before ye ViceChancellr for ye time being in ye Convocacon house.

That ye ViceChancellr & every member of ye Senate hath taken ye sd Oathes, & ye ViceChancellor & Senate are ye ꝑsons intrusted to putt ye sd Lawes in Execucon in ye sd Vniversitie.

That ye Vice Chancellr by his Oath of Office hath alsoe sworne duely to execute his Office according to ye Lawes, & cannot admitt to any Degree without ye Senate.

That ye sd Statutes were made for ye preservation of ye Doctrine & Religion professed by ye Church of England, & established by ye Lawes of this Kingdome, & of ye Prerogative & rightfull power of his Matie.

That upon ye receipt of his Mats sd Letters Mandatory, the same were by ye Vice Chancellr com̄unicated to ye sd Senate & in order to ye admitting ye sd Alban ffrancis to ye Degree of Mastr. of Arts, ye sd Oathes were offered to be adminstred to ye sd Alban ffrancis if he would take ye same, wch he refused to doe.

That ye admitting him without takeing ye sd Oathes had been contrary to ye sd Statutes, & a breach of ye trust in ye Vice Chancellr & Senate reposed & a violacon of their Oathes, & Therefore they could <2r> not admitt ye sd Alban ffrancis to ye sd Degree, And by their humble applicacon to his sacred Matie did & now againe humbly desire yor Lordpps to represent this their Case to his Matie yt they may not lye vnder his Mats displeasure vpon any Misapprehensions thereof.

Butt whither yor Lordpps will as a Court take Conusance of this Matter, they humbly pray yor Lordpps consideracon since yt ye taking of ye Degree of Master of Arts in ye Vniversity, or the admitting or refuseing to admitt to such Degree is not any cause or matter Ecclesiasticall or Spirituall, but of Lay & Temporall conusance.

And they further humbly offer to yor Lordpps yt by ye Statute made in ye sixteenth yeare of ye Reigne of his Mats most Royall ffather King Charles ye first Entituled an Act for repeale of ye branch of a Statute primo Eliz: concerning Comrs for causes Ecclesiasticall, & whereby ye sd branch is repealed, It is enacted yt no new Court shall be erected, ordained, or appointed within this Realme wch shall or may have like power, Iurisdiccon or Authorityes as ye High Comission Court then had or prtended to have, but yt all & every such Comissions & Grants, & all powers & Authorities Granted or prtended to be Granted thereby shall be void & of none effect as in & by ye Statutes more fully appeare.
